![]() Ortho-McNeil Pharmaceutical, LLC (owned by Johnson & Johnson) plead guilty in court for its part in illegally promoting Topamax, a drug developed for epilepsy which was never approved by the FDA. They were fined $6.14 Million. An Affiliate of the company, Ortho-McNeil-Janssen Pharmaceuticals, Inc. will also pay $75.37 million! Ortho-McNeil promoted a program called "Doctor For A Day" which was pay for Physicians to go along with sales reps on their sales calls. The Physicians would promote the Brand Topamax, primarily to Psychiatrists to treat psychiatric conditions. Again to FDA approval was ever granted to Ortho-McNeil and Ortho-McNeil never applied for approval that Topamax would treat psychiatric disorders. US Attorney Carmen M. Ortiz stated "We will remain vigilant in our enforcement of these laws regardless of what form the conduct takes," He also stated, "This case should send a strong reminder that the off-label promotion of pharmaceuticals is illegal, whether it is don directly by company employess, or through programs such as 'Doctor For A Day' ". The $75 million from Ortho-McNeil Janssen Pharmaceuticals, Inc, will go to resolve civil allegations under the False Claims Act.
